During the pendency of a divorce proceeding, an important issue that needs to be addressed is that of maintenance (formerly known as alimony, and in some states called spousal support).


Our firm is aware of the emotional and financial hardships which some spouses go through during a divorce proceeding. Most often parties going through a divorce making decisions based on their emotions not on what they are entitled to. During this emotional time they often want to end the marriage quickly and do not take into consideration that they are entitled to certain benefits such as temporary and/or permanent maintenance.


As to maintenance, the Court considers many factors to determine whether maintenance should be awarded or not, and if so, in what amount. The following are some of the common factors that the courts take into consideration


  • How long the marriage lasted
  • the income and property of each party, including marital property and non-marital property assigned to the party seeking maintenance
  • the needs of each party
  • any impairment of the present and future earning capacity of the party seeking maintenance the present and future earning capacity of each party
  • any valid agreement of the parties
  • the standard of living established during the marriage
  • contributions and services by the party seeking maintenance to the education, training, career or career potential, or license of the other spouse.
  • The time necessary to enable the party seeking maintenance to acquire appropriate education, training, and employment, and whether that party is able to support himself or herself through appropriate employment or is the custodian of a child making it appropriate that the custodian not seek employment
